Indigenous Peoples' Residency
The Kansas Legislature enacted a provision to allow certain students enrolling at a public institution of higher education in Kansas to have residency status for the purpose of tuition & fees. This current provision is in place from July 1, 2024, through June 30, 2025. (per Section 118(e) of 2025 Senate Bill 125)
Students who are enrolled as a member of the following Nations are eligible for residency status at Kansas public institutions of higher education, regardless of the location of their residence:
- The Kickapoo Tribe of Indians of the Kickapoo Reservation in Kansas
- The Prairie Band Potawatomi Nation
- The Iowa Tribe of Kansas and Nebraska
- The Sac and Fox Nation of Missouri in Kansas and Nebraska
As well as the following Indigenous Nations with historical connections to Kansas territories with one or more of the following references within the Tribe's name:
- Apache
- Arapaho
- Caddo
- Cheyenne
- Cherokee
- Chickasaw
- Chippewa and Ojibwe (including Bay Mills)
- Choctaw
- Comanche
- Delaware
- Iow (Ioway and Baxoje)
- Kaw
- Kickapoo
- Kiowa
- Miami
- Missouria (including Otoe-Missouria)
- Modoc
- Muscogee (Creek, including Yuchi, Euchee or Uchee)
- Nez Perce
- Omaha
- Oneida
- Osage
- Otoe
- Ottawa (Odawa)
- Potawatomi (Pottawatomi)
- Pawnee
- Peoria
- Ponca
- Pueblo
- Quapaw
- Sac and Fox (including Meskwaki)
- Seminole
- Seneca-Cayuga
- Shawnee
- Stockbridge-Munsee (Mochican)

Any student residing in Allen County, Kansas
OUT-DISTRICT
Any Kansas student residing outside of Allen County, Kansas
OUT-OF-STATE
Any United States student residing outside of the state of Kansas
INTERNATIONAL
Any student residing outside of the United States and it’s territories
HIGH SCHOOL CONCURRENT
Students enrolled in courses taught in High School by a teacher employed by a USD.
HIGH SCHOOL DUAL CREDIT
Students enrolled in courses taught online or in High School by an Allen Faculty Member.
HIGH SCHOOL EXCEL IN CTE
Allen approved Career and Technical Education Courses taught online or in High School.
Immigration Status Definitions
DACA
Protection for those individuals that arrived in the United States as children
UNDOCUMENTED
Individuals living in the United States without a legal immigration status.
CITIZEN OF MARSHALL ISLANDS
While not a US citizen, can legally live, work, and study in the United States
HOUSE BILL 2145
Allows students without legal immigration status and students with a legal non-permanent immigration status to receive in state tuition when certain criteria are matched:
- Reside in Kansas for a minimum of 6 months prior to the start of classes for the semester
- Must submit documentation verifying a minimum of 3 years of attendance and completion of high school in Kansas
- Affidavit regarding applying for legal status
